This website is owned and operated by Lucasian Ltd, who own RugbyMax Nutrition(“we” or “us”). We are registered in England and Wales under Company number 06988488, our office is at 80 Ability Plaza, Arbutus Street, London E8 4DT
1. Service Availability
By using this site, including when making any purchase of products, you agree to be bound by these terms and conditions. We reserve the right to update and/or amend these terms and conditions from time to time, so you are advised to check them regularly. In respect of any order for the purchase of products, that order will be governed by the terms and conditions in place at the date of that order (subject to any subsequent amendments required by law). This site is intended for use by people resident in the United Kingdom or the EU. We do not accept orders from individuals outside of the United Kingdom or Europe.
2. Your Status
By placing an order through our site, you warrant that:
1. you are legally capable of entering into binding contracts;
2. you are at least eighteen (18) years old; and
3. you are resident in the United Kingdom or Europe
3. Prices
The price of any products will be as quoted on our site from time to time except in cases of obvious error. These prices include VAT but exclude delivery costs which will be added to the total amount due as set out in the Purchase Section. Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent out a confirmation.
4. Purchase of Products
From the Buy Now page, you can select the delivery price and proceed. The next page enables you to amend your order or to continue shopping.
To click on the 'Checkout' button and you will be transferred to the Checkout page, which will display the value of the products and the postage price.
You will be asked to enter an email address for us to send confirmation of your order and despatch of your purchase.
You will be asked to select a credit card from which payment will be taken and to submit your credit card information to our secure server.
You will receive an email from us confirming receipt of your order.
We reserve the right not to accept any order of over £1,000.
5. Delivery
We can deliver RugbyMax to you FREE OF CHARGE to destinations within the UK. We aim to get your product to you within 72hrs.
Or we can offer guaranteed next day delivery before 1pm for an additional charge of £3.99. For security reasons, to protect you, and to prevent fraud, we currently only offer delivery to the same address as the billing address. For your safety, we require a signature upon delivery. It is your responsibility to ensure that someone is available at the delivery address to accept, via signature, receipt of the products. This signatory does not have to be the same person as the name provided on the delivery package.
At RugbyMax we only use top-class partners for delivery.
If you are ordering from the European Union different delivery charges will apply.
EU delivery normally takes 5 days and costs £6.75, or approximately 7.50EUR. For more information contact us at europe@rugbymaxnutrition.com. We do not currently deliver outside the European Union, please contact us on international@rugbymaxnutrition.com to discuss the possibility of delivery.
6. Our Contract
On submission of an order, you will receive an email from us confirming receipt of your order. This confirmation will include details of the products ordered and the estimated delivery time. Your order will constitute an offer to us to purchase the products in question; we will transfer your payment on receipt of the order, although if we are unable for any reason to process delivery of the order we will give you a full refund for the undelivered products. We will not be deemed to have accepted your order, and a contract will not be formed, until your products have been dispatched to your delivery address. Where we have dispatched only some of the products contained in an order, the order for the remaining un-dispatched products will not be deemed accepted until they themselves are dispatched.
6. Returns and Refunds
If you would like to return part or all of your order, please return the goods accompanied by the packing slip which accompanied your order. Write on the reverse of the form the reason for return and the amount of the product you've used. Send the goods back to RugbyMax Nutrition, 80 Ability Plaza, Arbutus Street, London E8 4DT. You are responsible for all postage and packing costs and these will not be refunded.
- If after the first few (1- 3) scoops you don’t like the taste or the way the products mix, you will receive a full refund, less costs of postage and packing which are non-refundable.
- Beyond this, refunds will be offered on a proportionate basis to reflect how much of the product has been used.
- The product will be weighed on return to RugbyMax Nutrition to establish how much has been returned.
- Please allow at least 7 working days for your refund or exchange to be processed.
- If you take advantage of any offers on the same product, all tubs/bottles/bars (including empty containers) will need to be returned for a refund to be made. Please ensure that tamper evident seals on unused products are not broken (other than the one tried) as only the sealed products can be refunded in full.
- Refunds and exchanges can only be given for products received by us within 50 days from receipt of order and only if we have the original packaging and any remaining content returned to us. However, exchanges will not be further exchanged or refunded. Products that are out of date will not be refunded.
- We cannot be held responsible for lost returns, caused by your choice of carrier. We therefore recommend you send your goods back via a recorded, special or proof of delivery service.
RugbyMax Nutrition’s money back guarantee does not affect and is in addition to your statutory rights.
Postage and packing costs are non-refundable and deducted from the price.
Please note that we can only refund or exchange products purchased through this site. If you purchased the product elsewhere, please contact that retailer directly.
7. Cancellations
You have the right to cancel an order at any time within 7 days working days beginning on the day that you received your order by contacting our Customer Services team on 0845 388 3635.
If your order has not been despatched from our warehouse we will cancel the order and refund you in accordance with our returns and refund policy in section 8. If the order has already been despatched and we are not able to cancel the order you may return the order once you have received it in accordance with our returns and refund policy in section 8.
8. Availability
Where products are unavailable for purchase, this will be marked on the relevant product information page. However, the availability of a product cannot be guaranteed by its availability being shown on the relevant product information page. Despite our best efforts to keep the pages as up-to-date as possible, the availability of a product may alter in advance of the information on the relevant product information page being updated; this may lead to us being unable to accept an order. In these circumstances - subject to cancellation by you, we will keep your order open until fresh stocks of the product are received. We will inform you by email if we are unable to process, or otherwise accept, your order within 30 days of the date of your order, in which case you will be given the option either of being reimbursed the value of your order or of resubmitting or substituting your order.
9. No warranty
This site is controlled and operated by us from our offices in the UK. We make no representation that material in the site is appropriate or available for use in other locations. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent that local laws are applicable.
We use reasonable efforts to regularly update the site, but make no representation or warranty in respect of accuracy or lack of errors.
Use of the site is at the risk of the user. We take no responsibility for direct, indirect or consequential loss from use of the site and all implied warranties are excluded to the extent permissible under English law.
We accept no liability for viruses infecting the user following its use of the audio, video, data or text on the site.
10. Our Liability
We warrant to you that any product purchased from us through our site is of satisfactory quality and reasonably fit for all purposes for which products of the kind are commonly supplied.
Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the products you purchased.
Without in any way limiting our liability for death and/or personal injury caused by our negligence or breach of duty, we will not be liable for any direct, indirect or consequential loss. Without limiting your statutory rights, we will not be held liable for any failure to fulfil our obligations hereunder caused by events beyond our reasonable control. No failure by us to enforce a right hereunder will be deemed a waiver of that right.
Any condition or term herein deemed for any reason invalid or legally unenforceable will be deemed severable from these terms and conditions and will not affect the enforceability of the remaining terms and conditions.
11. Force Majeure
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations in connection with an order that is caused by events outside our reasonable control (“Force Majeure Event”).
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
1. Strikes, lock-outs or other industrial action.
2. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
3. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
4. Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
5. Impossibility of the use of public or private telecommunications networks.
6. The acts, decrees, legislation, regulations or restrictions of any government.
Our performance under in regards to any order is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations may be performed despite the Force Majeure Event.
12. Written Communications
You agree that communications between you and us will be made by email or other electronic means, and you consent to receive all communications from us in an electronic format. By agreeing to these terms and conditions, you agree that you have elected to enter any agreement for the purchase of products electronically and to receive any required communications, notices or updates in an electronic format.
13. Assignment of rights
You may not transfer or assign any of your rights under these terms and conditions. We may transfer or assign any of our rights or obligations at any time where we reasonably believe that your rights will not be affected.
14. Government Law
These terms and conditions and any orders made from the site are governed by English law. Any dispute or conflict arising out of or in connection with these terms and conditions or an order from the site shall be subject to the exclusive jurisdiction of the English courts.
Entire Agreement
These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any order and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
15. Nutrition and training advice
While every effort has been made to ensure that advice on this site is correct and up-to-date, the advice given on this site is of a general nature only and we make no claims or warranties as to its accuracy, or usefulness; such information should not be relied upon by any particular individual or for any specific purpose. Specific medical advice should always be sought from a qualified medical practitioner.
